Terms of service
These Terms and Conditions apply to every order placed with Edith, Nell & Rose. Please read them before you buy. They do not affect your statutory rights as a consumer.
Article 1. Definitions
Consumer: any individual buying for purposes outside their trade, business, craft or profession.
Distance contract: a contract concluded between us and you without us meeting in person, through this website.
Cancellation period: the period in which you may cancel your order without giving a reason.
We, us, our: Edith, Nell & Rose, as identified in Article 2.

Article 3. Scope
These terms apply to every offer we make and every contract concluded between us and you. We make them available to you before you order, in a form you can save and print.
If any part of these terms is found to be unenforceable, the rest continues to apply.
Article 4. Offers and prices
All prices shown include UK VAT.
The price you see at checkout is the total you pay. Delivery is free, and there are no customs duties, import VAT or handling fees to pay on arrival.
Where a piece is shown with a higher price crossed out, that is the price the item was previously offered at. Product photography is representative; because our pieces are finished by hand, small variations in stones and finish are normal and are not a fault.
Offers are valid while stocks last. Obvious pricing or typographical errors do not bind us, and we will contact you before processing an order affected by one.
Article 5. The contract
A contract is formed when we send you an email confirming that your order has been dispatched. The order confirmation you receive immediately after checkout is an acknowledgement, not an acceptance.
If we cannot fulfil your order, we will tell you and refund any payment in full.
Article 6. Your right to cancel
Under the Consumer Contracts Regulations 2013 you may cancel your order within 14 days of delivery, without giving a reason. We extend that period to 30 days.
You then have a further 14 days to return the item.
Returns are sent to our supplier's warehouse, which is outside the United Kingdom. You pay the cost of returning the item, including international postage and any customs or handling charges. We tell you this before you order so that you can factor it in.
The right to cancel does not apply to pierced earrings or other items sealed for hygiene reasons once the seal is broken, or to personalised and engraved pieces.
Sale and discounted items carry exactly the same cancellation rights as full-price items.

Article 7. Refunds
We refund you within 14 days of receiving the item back, or of you supplying proof that you have sent it, whichever comes first.
We refund the full price you paid, to the payment method you used. We do not charge restocking or administration fees.
If a returned item shows more handling than you would give it in a shop, we may reduce the refund to reflect the loss in value.
Article 8. Delivery
We deliver to addresses in the United Kingdom. Delivery is free on every order.
Unless we agree otherwise with you, we deliver within 30 days of the day you place your order. If we miss that, you may set a new deadline; if we miss that too, you may cancel and receive a full refund.
Risk in the goods passes to you when the parcel is delivered to the address you gave us.
Article 9. VAT, duties and import charges
We are responsible for accounting for UK VAT on your order. Prices shown include it.
You will not be asked to pay import VAT, customs duty or carrier handling fees on delivery. If a carrier ever asks you for such a charge, do not pay it: contact us and we will resolve it.
Article 10. Conformity and your legal rights
Under the Consumer Rights Act 2015 the goods we supply must be as described, of satisfactory quality and fit for purpose.
- Within 30 days of delivery you may reject a faulty item and ask for a full refund
- After 30 days you may ask for a repair or replacement
- If a repair or replacement is not possible or does not put it right, you may ask for a price reduction or a refund
Nothing in these terms shortens or limits those rights. Alongside them, every piece carries our lifetime warranty against manufacturing faults.
Article 11. Complaints
Email info@edithnellrose.com with your order number and what has gone wrong. We acknowledge complaints within 2 working days and aim to resolve them within 14 working days.
If we cannot resolve it between us, you can contact your local Trading Standards service through Citizens Advice.
Article 12. Liability
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking this contract or failing to use reasonable care and skill.
We do not limit our liability in any way that the law does not allow. That includes liability for death or personal injury caused by our negligence, for fraud, and for any breach of your statutory rights as a consumer.
We are not liable for delays outside our reasonable control, such as severe weather, carrier disruption or customs holds, but we will tell you as soon as we can and you may cancel and be refunded if the delay is substantial.
Article 13. Personal data
We handle your personal data as set out in our Privacy Policy.
Article 14. Governing law
These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts, and you keep the benefit of any mandatory consumer protections that apply where you live.
Article 15. Changes
We may update these terms. The version that applies to your order is the one published when you placed it.
